Learned AGA, contends that from a perusal of the F.I.R. and the material gathered during the course of investigation prima facie offence is disclosed against the applicant. The applicant had received the case diary of the criminal case which was required to be produced before the trial court on the appointed dates. However the applicant failed to return the said case diary and no entries in regard to the said return were made in the official documentation.

Faced with this, Shri Vineet Kumar Mishra, learned counsel for the applicant does not press the prayer sought in the applicant. He recasts his relief and submits that the applicant may be permitted to apply for bail and also to file a discharge application through counsel before the learned trial court.

It is always open to the applicant to invoke his remedy available to him in law. However, in case the applicant invokes such remedy, the competent court shall decide the same expeditiously and in accordance with law.

The Application U/S 482 is disposed of.
