Shri Amar Bahadur Maurya, learned counsel for the applicant and Shri A.K. Rai, learned A.G.A. for the State are present.
Present application under Section 482, Cr.P.C. has been filed by the applicant to quash the order dated 7.12.2023 passed in Session Trial No. 994 of 2022 (State Vs. Umnesh @ Khalifa), arising out of case crime No. 222 of 2020, under Section 307, I.P.C., Police Station Piluwa, District Etah, pending in the court of Additional Sessions Judge, Court No. 1, Etah, whereby the applicant has been summoned under Section 319, Cr.P.C. for trial.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction.
The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
Office shall return the certified copy of the order to the learned counsel for the applicant, after retaining a xerox of the same.
