Heard learned counsel for the applicants and learned A.G.A. for the State.

It is submitted by learned counsel for applicants that there was property related dispute between the parties and case is pending before the civil court. The impugned complaint has been lodged in order to settle score in civil dispute. In her statement recorded under Section - 200 Cr.P.C., complainant has made merely a vague allegation that applicants came at her house and did 'maarpeet' with her. The complainant has not sustained any injury. Referring to these facts, it was submitted that no case is made out against applicant.

Matter requires consideration.

Issue notice to the opposite party no.2, returnable at an early date.

Opposite party no.2 may file counter affidavit within four weeks.

List this case on 07.02.2025 .

It is directed that till the next date of listing, no coercive action shall be taken against the applicants, namely, Satish Kumar, Ravi, Amit and Hemant in Criminal Complaint No. 9505 of 2022 (Smt. Lokesh Devi Vs. Satish Kumar and Others), under Sections - 323, 452, 506 I.P.C., Police Station - Nandgram, District - Ghaziabad, pending in the court of Additional Chief Judicial Magistrate, Court No.3, Ghaziabad.
