Learned counsel for both the parties are present.

This application u/s 482 Cr.P.C has been filed by the applicants with the prayer to quash the entire proceedings of Case No.120339 of 2023 (State Vs. Nikhil Verma and other) arising out of Case Crime No.978 of 2022 under sections 308, 147, 323, 325 IPC, Police Station Chakeri, District Kanpur Nagar pending in the Court of learned Chief Judicial Magistrate, District Kanpur Nagar on the basis of compromise dated 19.01.2024.

It is submitted by the learned counsel for the applicants that in this case parties have entered into compromise and settled their dispute amicably in pursuance to the order passed by this Court on 22.03.2024 in Criminal Misc. Application under Section 482 Cr.P.C No.5017 of 2024. The compromise was filed before the learned trial court which was got verified vide order dated 20.04.2024. Certified copy of which is on record, therefore, request to quash the proceeding of the case in terms of compromise between the parties.

Learned counsel for the opposite party no.2 and learned A.G.A. has no objection in this regard.

On considering the facts and circumstances of the case, submissions made by the learned counsel for the parties and perusal of record, and the certified copy of compromise between the parties as verified by the learned trial court, it will serve no purpose in keeping the proceeding pending before the learned trial court, therefore, it is expedient and also in the interest of justice to quash the entire proceeding of the case including the charge sheet and order of summoning in terms of compromise.

In view of above facts, the entire proceedings of Case No.120339

of 2023 (State Vs. Nikhil Verma and other) arising out of Case Crime No.978 of 2022, under sections 308, 147, 323, 325 IPC, Police Station Chakeri, District Kanpur Nagar pending in the Court of learned Chief Judicial Magistrate, District Kanpur Nagar are hereby quashed.

The application under Section 482 Cr.P.C. is allowed.
