Heard learned counsel for the applicants, learned counsel for the opposite party no. 2 as well as learned A.G.A. for the State and perused the record.
The present application has been filed by the applicants with prayer to quash the entire proceeding in Case No. 220 of 2018 arising out of Case Crime No. 252 of 2017, under Sections 147, 148, 149, 323, 504, 325 IPC, Police Station Tharwai, District Allahabad, pending in the court of learned Additional Chief Judicial Magistrate, Court no. 5, Allahabad on the basis of compromise dated 8.8.2023 between the parties and same was verified by the learned court concerned vide order dated 22.3.2024.
It is submitted by learned counsel for the applicants that in this case, parties entered into compromise and it was filed before the learned court concerned and verified on 22.3.2024 in pursuance to order passed by this Court on 26.2.2024 in Application u/s 482 No. 555 of 2024. Since parties have settled their dispute amicably, therefore, request to quash the entire proceeding of the case.
Learned counsel for the opposite party as well as learned A.G.A. have no objection.
On considering the facts and circumstances of the case, submissions made by learned counsel for the applicants as well as learned A.G.A. and the fact that dispute between the parties has been settled amicably and compromise entered into between the parties has already been verified by the learned trial court the copy
of which is on record, therefore, it will be of no use to keep the proceedings pending before the learned court. As a result, it will be in the interest of justice to quash the entire proceedings of the case in terms of compromise.
Accordingly, the entire proceedings of the aforesaid case are hereby quashed in terms of compromise between the parties.
Accordingly, the present application is, hereby, allowed .
