1. Heard learned counsel for the applicants and learned AGA for the State.

1. This application under Section 482 Cr.P.C. has been preferred for quashing of the entire proceedings, including summoning order dated 02.03.2024, of Complaint Case No.299 of 2023 (Chanchal Saini Vs. Dr Shekhar Saini and others), under Sections 498A, 323, 504, 506 IPC, Police Station- Banna Devi, District- Aligarh, pending before the Court of Judicial Magistrate/Additional Civil Judge (J.D.), F.T.C. No.2, Aligarh.

1. It has been submitted by learned counsel for the applicants that applicant no.1 is husband of the complainant/opposite party no.2 and their marriage has taken place way back in the year 2009. Only general allegations of dowry demand and harassment of complainant have been levelled and the entire family of applicant no.1 has been summoned by the learned Magistrate. Referring to facts of the matter, it was submitted that no prima-facie case is made out against the applicants.

1. Issue notice to opposite party no.2 returnable at an early date.

1. Opposite parties may file counter affidavit within four weeks.
