Heard learned counsel for the applicants and learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been preferred against the order dated 07.06.2024, passed by learned Additional Chief Judicial Magistrate, Court No.2, Agra, in Case No.1035 of 2017 (Aashiq Vs. Kadir and Others), under Sections 147, 148, 323, 506, 304 I.P.C., Police Station- Malpura, District- Agra, whereby non-bailable warrants have been issued against the applicants.

It has been submitted by learned counsel for the applicants that applicants were summoned in the complaint case and earlier they have filed an application under Section 482 Cr.P.C. for quashing of proceedings, wherein they were granted liberty to file discharge application. The said discharge application has been rejected by the trial Court. It was submitted that applicants are willing to appear before the Court concerned and thus, a direction may be made to the trial Court to decide their bail application expeditiously in accordance with law.

In view of aforesaid, it is directed that in case, applicants appear/ surrender before the court concerned within a period of two weeks from today and apply for bail, their bail application

shall be considered and decided expeditiously in accordance with settled law. It is further directed that for a period of two weeks from today or till the applicants surrender before the court below, whichever is earlier, no coercive action shall be taken against the applicants in the aforesaid case.

With the aforesaid observations, the application under Section 482 Cr.P.C. is disposed of .
