1. Heard Sri Prashant Verma, learned counsel for the applicant and Sri Pawan Kumar, Advocate holding brief of Sri Anurag Dubey, learned counsel for the opposite party no.2 and Sri Rajeev Kumar Singh, learned A.G.A. for the State.

The instant application has been filed seeking quashing of the summoning order dated 14.11.2022 in Complaint Case No. 15 of 2022 (Rajkumar vs. Chandrashekhar Yadav) and its consequential non-bailable warrants dated 08.05.2024 arising out of Complaint Case No. 256 of 2023, under Section 138 of the Negotiable Instruments Act, Police Station- Kotwali, District- Mainpuri, pending in the Court of learned Civil Judge (S.D.)/Judicial Magistrate, Mainpuri.
3. Learned counsel for the applicant seeks to withdraw the instant application, which is not opposed by learned A.G.A. as well as learned counsel for the opposite party no.2.
4. In view thereof, the instant application is dismissed as withdrawn .
