Heard learned counsel for the applicant and learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been filed for quashing of the entire proceedings, including summoning order dated 30.03.1997 and non-bailable warrant dated 07.10.1998, of complaint case no. 1350 of 1997, under Sections 354, 506 IPC, P.S. Sadar Bazar, District Shahjahanpur, pending in the court of C.J.M., Shahjahanpur.

After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and applicant may be permitted to move an application for discharge through counsel before the trial court concerned in accordance with law.

In view of aforesaid, the instant application under Section 482 Cr.P.C. is finally disposed of with direction to the trial court that in case applicant moves an application for discharge through counsel within a period of three weeks from today, the same shall be considered and decided expeditiously in accordance with law. For a period of three weeks from today and in case, such an application is moved within the aforesaid period, till the disposal of such application, no coercive action shall be taken against applicant, provided applicant co-operates in early disposal of the discharge application.

The application u/s 482 Cr.P.C. is finally disposed of in above terms.
