Heard Mohd. Hamza Shamim, learned counsel for the applicant, Sri Bhanu Pratap Singh, learned AGA for the State and Sri Prabhat Singh, who has filed Vakalatnama on behalf of opposite party no.2. Said Vakalatnama is taken on record.

This petition/ application has been filed for quashing of the entire proceedings of Criminal Case No.21165 of 2024 arising out of Case Crime No.464 of 2024, under Sections 419, 420, 467, 468, 471 & 406 IPC, Police Station- Kotwali Nagar, District- Gonda pending before the Court of Civil Judge (S.D.)/M.P./M.L.A., Gonda including the summoning order dated 02.04.2024 and charge sheet.

As per learned counsel for the applicant, parties have entered into compromise in the aforesaid criminal case and the compromise deed has been enclosed with this petition.

It is trite law that unless and until the contents and parties of compromise deed are duly verified either by the competent court or by the competent authority, no order can be passed by this Court under Section 482 Cr.P.C.

Therefore, place this paper book before the Senior Registrar of this Court on 16.01.2025 and all the parties of compromise deed shall appear before the Senior Registrar of this Court on that date. The Senior Registrar shall verify the contents and parties of the compromise deed and shall submit the report before this Court by the next date of listing.

List on 23.01.2025 as fresh.

Till the next date of listing, the applicant shall not be compelled to appear before the court below pursuant to the aforesaid criminal case.

When the case is next listed, name of Sri Prabhat Singh shall

be printed in the cause list as counsel for opposite party no.2.
