Heard learned counsel for the applicant, the learned A.G.A and perused the record.

The present application has been filed with the following prayer :

"(i) To quash the impugned order dated 25.10.2024 passed by learned Additional Sessions Judge/Fast Track Court-I, Lucknow in Sessions Trial No.2003 of 2022 "State Vs. Ravi Verma and others", arising out of Case Crime No.252 of 2019, under Sections 328, 376, 504 and 506 I.P.C., police station Mahila Thana, district Lucknow."

Learned counsel for applicant submits that it is an admitted case of the victim that she was in relationship with the applicant. It is alleged that on the pretext of marriage, she was physically abused by the applicant but, thereafter, applicant denied to marry the victim. Learned counsel for applicant submits that applicant is still ready for solemnizing marriage with the victim but the victim is now willing to only extract money from the applicant. He further submits that even in the bail application filed by the applicant the learned counsel for complainant, on the query of the Court, stated that the victim has blatantly refused to marry the applicant. It is the submission of learned counsel for applicant that the discharge application filed by the applicant was rejected by the court below in most cursory manner therefore, kind indulgence is necessary.

Learned A.G.A. vehemently opposes the prayer of the applicant and submitted that after considering all the material evidence available on record, the discharge application of the applicant has been rejected by the court below. He further submits that on the pretext of marriage, the victim was physically abused by the applicant.

Considering the submissions of learned counsel for the applicant, learned A.G.A. and going through the contents of the F.I.R. as well as other relevant documents, it is evident that the victim as well as applicant both are major and prudent person and they were in relationship but on refusal to marry with the victim the impugned first information report was lodged. As the learned counsel for applicant

submits that the applicant is still ready to marry the victim, therefore, this Court is of the view that the matter requires consideration.

Issue notice to the private respondent.

List this case on 04.02.2025.

On the next date of listing i.e. 04.02.2025, applicant as well as opposite party no.2 shall appear before this Court.

Till the next date of listing, further proceedings of Sessions Trial No.2003 of 2022 "State Vs. Ravi Verma and others", arising out of Case Crime No.252 of 2019, under Sections 328, 376, 504 and 506 I.P.C., police station Mahila Thana, district Lucknow, pending before the Court of Additional Sessions Judge/Fast Track Court-I, Lucknow, shall remain stayed.
