Heard Sri Firdos Ahmad, learned counsel for the applicant, Sri Manoj Kumar Dubey, learned counsel for the opposite party no. 2, Sri Ram Prakash Shukla, learned counsel for the State and perused the record.

This application under Section 482 Cr.P.C. has been filed by the applicant Ramraj Alias Bhuwar with the prayer to quash the order dated 04.3.2023 passed by Judicial Magistrate, Court No. 24, Azamgarh and order dated 05.3.2024 passed by Additional District and Sessions Judge, Court No. 6, Azamgarh on discharge application in Case No. 9431 of 2022, State vs. Harishankar @ Hariya, arising out of Case Crime No. 67 of 2017, under Sections 419, 420, 467, 468, 471 I.P.C., Police Station Jiyanpur, District Azamgarh. It is further prayed to stay the order dated 04.3.2023 passed by Judicial Magistrate, Court No. 24, Azamgarh and order dated 05.3.2024 passed by Additional District and Sessions Judge, Court No. 6, Azamgarh on discharge application in Case No. 9431 of 2022, State vs. Harishankar @ Hariya, arising out of Case Crime No. 67 of 2017, under Sections 419, 420, 467, 468, 471 I.P.C., Police Station Jiyanpur, District Azamgarh, during pendency of this application.

After arguments on merits at length learned counsel for the applicant states that he does not want to press the prayers made in the present petition on merits. He states that the purpose of the applicant would be served if he is permitted to appear before the trial court within a period of two weeks from today and file a regular bail application.

Learned counsel for the State has no objection of aforesaid arguments of learned counsel for the applicant.

In view of the above, the prayer as prayed for is dismissed as not pressed.

However, in view of the peculiar facts and circumstances of the case and looking to the limited prayer of learned counsel for the applicant, it is directed that if the accused-applicant appears and applies for bail before the court concerned within two weeks from today, the same shall be considered and decided in accordance with law.

The present application is disposed of.
