1. Heard Sri Jitendra Kumar, learned counsel for the applicants, Sri Ajay Singh, learned A.G.A.-I for the State and perused the record.

1. This application under Section 482 Cr.P.C. has been filed by the applicants Vikas Sharma, Vipin Siddhu, with the following prayers:-

"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the present Criminal Misc. Application of the applicants and quash the charge sheet dated 13.09.2018 in Case No. 5611 of 2018, State vs. Sukhveer and others, arising out of Case Crime No. 430 of 2017, under Sections 420, 406, 506 I.P.C., Police Station Dadari, District Gautam Buddh Nagar against the applicants and learned Additional Chief Judicial Magistrate, Gautam Buddh Nagar has taken cognizance and summoned against the applicants on 02.11.2018 pending in the court of learned Additional Civil Judge (J.D.)-II, Gautam Buddh Nagar.

It is further prayed that this Hon'ble Court may graciously be pleased to stay the entire criminal proceeding of Case Crime No. 430 of 2017, under Sections 420, 406, 506 I.P.C., Police Station Dadari, District Gautam Buddh Nagar against the applicants and learned Additional Chief Judicial Magistrate, Gautam Buddh Nagar has taken cognizance and summoned against the applicants on 02.11.2018 pending in the court of learned Additional Civil Judge (J.D.)-II, Gautam Buddh Nagar, and/or pass such other and further order which this Hon'ble Court may deem fit and proper under the circumstances of the present case, otherwise the applicants shall suffer irreparable loss and injury."
