Heard Sri Nilay Kumar Pandey, learned counsel for applicant and Sri Vikas Kumar holding brief of Sri Amarnath Tripathi, learned counsel for O.P. No.2.

Impugned summoning order in the present case is passed under Section 204 Cr.P.C. on 30.1.2024, whereby the applicant was summoned under Sections 406, 420, 504 and 506 I.P.C. For reference same is reproduced hereinaftrer:

पररिवनदि पत कन सनांदक्षिप्त कथन हहै दक पररिवनदिली एवनां दवपक्षिली आपस मम करिलीबली ररिश्तपेदिनरि हहै धजसकपे चलतपे दवपक्षिली कन आनन-जननन पनथर्थी कपे घरि लगन रिहतन थन। ककोदवड 19 कपे चलतपे वरर 2021 मम जब पपूरिपे भनरित मम ललॉकडनउन चल रिहन थन दवपक्षिली व उसकन पररिवनरि पभनव मम आ गयन थन धजसकपे चलतपे उसककी आधथरक ससथदत खरिनब हको गयली। दवपक्षिली दनरिन पनथर्थी सपे अपनपे तथन अपनपे पररिवनरि कपे दिवन इलनज व भरिण-पकोरण कपे धलए बततौरि उधिनरि पहैससों ककी मननांग ककी गयली थली। ददिनननांक 05.05.2021 कको छछः मनह कपे धलए मद० 1,00,000/- रुपयपे नगदि व मद० 2,00,000/- रुपयन जररियपे चपेक ददियन गयन। कदल मद० 3,00,000/- रुपयपे दवपक्षिली दनरिन धलयन गयन। लगभग छछः मनह सपे अधधिक कन समय व्यतलीत हको जननपे कपे बनदि भली दवपक्षिली दनरिन पहैसन वनपस नहहीं दकयन गयन तको पनथर्थी नपे दवपक्षिली सपे सनांपकर दकयन धजस परि दवपक्षिली नपे अपनली मनलली हनलत खरिनब हकोनपे कन हवनलन दिपेतपे हहए पनथर्थी सपे

समय ककी मननांग ककी गयली। लगभग डपेढ़ सनल बलीतनपे कपे बनदि पररिवनदिली थक -हनरि करि दवपक्षिली कको अपनपे पहैससों कपे धलए फकोन करिनन आरिनांभ दकयन तको दवपक्षिली दनरिन पनथर्थी/पररिवनदिली कन फकोन नहहीं उठनयन गयन , तको पनथर्थी नपे बपेटसों कपे सनथ दवपक्षिली कपे घरि जनकरि वनतनर करिनपे कन पयनस दकयन। दवपक्षिली अपनपे घरि कपे बनहरि हली पनथर्थी कको आयन हहआ दिपेखकरि आगबबपूलन हको गयन तथन मननां -बहन ककी भदली-भदली गनलली दिपेतपे हहए रुपयन वनपस करिनपे सपे मनन करि ददियन, सनथ हली यह भली धिमककी ददियन दक दिकोबनरिन पहैससों ककी मननांग करिपेगन तको पहैसपे सपे उसककी हत्यन करिन दिपेगन।

200 पररिवनदिल मी दकदिमन नपे अपनपे बयनन अन्तगरत धिनरिन दि०प०सनां० मम कथन 2021 दकयन गयन ह दक भहै प ूपेन्द्र मपेरिल बही ह कपे सगपे चनचन ह अपहै हैल मम इन्हम ककदवडो हहआ थन, तब 05.05.2021 कक एक लनख औरो ि दिक लनख कन चो पेक मनम पे इन्ह , - , इलनज कपे धलए ददियन थन बकलो पे छछः सनत महलनी पे मम वनपस करि दिमग नहह दकयन।ीं 29.06.2023 5-5.30 मपेरिन फकन नहहो उठनयन। मीं ददम िनननांक कक शनम कको लगभग ो बजपे कक अपनो पे बपेटपे शशननांक व दशवननांक कपे सनथ भ प ूपेन्द्र कपे घऱ गयन। घरि कपे बनहर - 6 हल गनलली गलतज व जनन सौ पे मनरिनपे कक धी मककि दी िल। मी है लतट गयन। ौ जलनई ककद , नकदटस भलो भी पेजन महैन वक को पे स वनपस लपेनपे कक धी िमकक दी िपेतपे ह।है 200 पररिवनदिली नपे अपनपे पररिवनदिपत कपे कथनसों कपे समथरन मम सवयनां कको धिनरिन दिनां०प०सनां० कपे तहत एवनां धिनरिन -202 कपे तहत सनक्षिली दशवननांक दतपनठली व शशननांक दतपनठली परिलीदक्षित करिनयन गयन हहै। परिलीदक्षित गवनहनन कपे बयनन अन्तगरत धिनरिन 202 दि०प०सनां० मम पररिवनदिली कपे कथनसों कन समथरन दकयन हहै।

पतनवलली परि उपलब्धि उपरिकोक सनक्ष्यसों कपे आधिनरि परि अदभयदक भ प ूपेन्द्र कदमनरि दमशन उफर भकोनपू कपे दवरुद्ध पथम दृष्टयन धिनरिन 406,420,504,506 भन.दि.सनां. कन अपरिनधि बनतन हहै।

अदभयदक उपरिकोक कको दवचनरिण हपेतद तलब दकयपे जननपे कन आधिनरि पयनरप्त हहै।

recorded under Section 200 Cr.P.C. which is reproduced hereinafter:

2021 मम पररिवनदिली नपे बयनन ददियन दक "भ प ूपेन्द्र मपेरिल बही ह कपे सगपे चनचन ह। अपहै हैल 5.5.21 2 लनख कन इन्हपे ककदवड हो हआ थन। तथन कक एक लनख औरो ि उसल ददी िन 6-7 , नहल चहैक मपेनपे उन्हपे इलनज कपे धलए ददियन थन। बकलो पे महलनी पे मम वनपस करि दिपेग दकयन, 29.06.23 5- मपेरिन फकन नहहो उठनयन। मीं ददम ि० कक मो है शनम कक लगभग ो 5.30 बजपे कक अपनो पे बपेटपे शशननांक व दशवननांक कपे सनथ भ प ूपेन्द्र कपे घरि गयन। घरि कपे 6 बनहरि हल गनलली गलती ज व जनन सौ पे मनरिनपे कक धी िमकक दी िल मी है लतट आयन। ौ जदलनई , " कक नको दटस भलो भी पेजन महैन वक को पे स वनपस लपेनपे कक धी िमकक दी िपेतपे ह। म

Learned counsel for applicant submits that even considering contents of aforesaid statement to be a gospel truth, still basic ingredients of Sections 406,420.504 and 506 I.P.C. is not made out.

Learned counsel for the O.P. No.2 is not able to assist the Court since he has not been able to refer above referred sections from bare act since he is not carrying the same.

In aforesaid circumstances this Court perused ingredients of Sections 406,420.504 and 506 I.P.C.

I have also carefully perused statement of complainant recorded under Section 200 Cr.P.C. which is referred above.

The maximum case of complainant could be that accused person has not returned the money given by him for purpose of his treatment during Corona period. Even it is not stated as to whether said money was given on assurance of its returning except in a vague manner as well as basic ingredient of Section 415 I.P.C. where cheating has been defined that whoever, by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any property to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived is also not made out. More over, in the present case, allegations of fadulently or dishonestly inducing the complainant are also absolutely missing.

Learned counsel for the O.P. No.2 has not been able to satisfy the Court that applicant was fradulently or dishonestly, induced to give money to the proposed accused persons and it was his intention since begining not to return it, therefore, I am of considered opinion that ingredients of Sections 406, 420 as well as 504 and 506 I.P.C. are also absolutely not made out since neither there was any allegation of raising any alarm or to use of abusive language or threat to the extent that complainant may be provoked to breach peace.

Aforesaid analysis is supported by judgment of Supreme Court in Mohammad Wajid & Anr. Vs. State of U.P. & Ors, 2023 INSC 683 , which has been followed by this Court in Application No.9131 of 2024, Dr Hemika Agarwal And Another Vs.State of U.P. and Another, Neutral Citation No.2024:AHC:114885.

In aforesaid circumstances since none of the ingredients of above referred Sections are even prima-facie made out, therefore, it is a fit case, where inherent powers could be invoked.

Accordingly impugned summoning order dated 30.1.2024 passed by Judicial Magistrate, Court No.2, Varanasi in Complaint No.109664 of 2023 ,(Nand Kumar Tripathi Vs. Bhupendra Kumar Mishra Alias Bhonu) is set-aside and this application is allowed.
