Heard learned counsel for the petitioner and learned Standing counsel appearing on behalf of the respondent no. 2.

No notice need be issued to the respondents no. 3 to 6 taking into consideration the nature of order proposed to be passed.

The contention of learned counsel for the petitioner that aggrieved against the order dated 16.11.2023j passed in Case No. 224 of 2023 Inre; Ibne Abbas Vs. Haider Raza by the learned Additional District Magistrate (Finance and Revenue), Ambedkar Nagar, the petitioner filed his appeal which has been registered as Case No. 135 of 2023 Inre; Haider Raza Vs. Ibne Abbas. He states that an application for interim relief has also been filed in the said appeal but the same has not been decided and on the other hand, the respondents are pressing on for eviction of the petitioner.

The contention is that once the aforesaid interim relief application is pending before the Court concerned consequently, the said application be decided first by the competent authority.

Considering that an application for stay is pending for consideration in Case No. 135 of 2023 filed by the petitioner and the next date fixed is 12.02.2024, as per the order sheet, a copy of which has been filed as annexure 6 to the writ petition, the instant petition is disposed of with the direction to the respondent no. 1 to decide the pending interim relief application of the petitioner in accordance with law after hearing all the parties concerned provided there is no legal impediment either on the date fixed i.e 12.02.2024 or within next two weeks thereafter.
