Heard learned counsel for the petitioner. Notice on behalf of the respondents No.1 and 2 has been accepted by the office of Chief Standing Counsel. Shri Pankaj Gupta, learned counsel has accepted notice for the respondent No.3.
By means of the instant petitioner, the petitioner seeks the following main relief, which reads as under:-
"(i) Issue a directing to the opposite party no.1, i.e. the Court of Tahshildar (Judicial), Tehsil-Mankapur, District-Gonda, to consider and decide the application no.T202308300701190 (State Vs. Bairagi), is pending for order"
A specific query was put to the learned counsel for the petitioner as to whether the present petitioner is a party to the proceedings of which expedition has been sought to which he submitted that the petitioner is not a party but it is upon his complaint that the proceedings were initiated. Hence, he has a right to seek expedition.
Having considered the aforesaid and noticing that the petitioner is not a party to the proceedings by which the expedition is being sought. Accordingly, this Court is not inclined to entertain the petition at the behest of a third party.
In view of the aforesaid, the petition is dismissed .
