Heard learned counsel for the petitioner, learned A.G.A for the State and perused the record.
This petition under Article 227 of the Constitution of India has been filed seeking direction to the learned Judge Family Court, Mainpuri to order the payment of rest amount in Misc. Case No. 220 of 2022 under Section 125 (3) Cr.P.C. (Avnish Kumari and another Vs. Jitendra Kumar) pending before the Family Court, Mainpuri.
Considering the aforesaid facts and circumstances of the case and without expressing any opinion on the merits of the case, this petition is finally disposed of with a direction to the court concerned to decide the aforesaid case in accordance with the provisions of Section 125 (3) Cr.P.C. within a period of sixty days, as expeditiously as possible, after giving opportunity of hearing to both the parties, without granting any unnecessary or long adjournments to either of the parties, from the date of production of a certified copy of this order, if there is no other legal impediment.
