Learned counsel for the petitioner has submitted that the present petition has been preferred for issuing a direction to the respondent no.2 i.e. Civil Judge Junior Division Tehsil Utraula District- Balrampur to decide the case no. 0316/2023 for permanent injunction within stipulated period fixed by this Hon'ble Court.
The above suit for permanent injunction was filed on 5.7.2023. The petitioner has approached this Court at a very early stated for issuance of a direction to the trial to decide the suit for permanent injunction within one year of the filing of the same particularly when neither the written statement has been filed nor any issue has been framed or any evidence has been led. At this stage, learned counsel for the petitioner has submitted that the petitioner may be permitted to withdraw the present writ petition and the same may be dismissed as not pressed with a liberty to approach this Court at the appropriate stage.
As prayed, the writ petition is dismissed as not pressed with liberty to approach this Court at the appropriate stage.
Certified copies of the orders may be returned to the learned counsel for the petitioner after retaining the photocopies of the same.
