Heard learned counsel for the petitioners, learned AGA for the State.

The present petition under Article 227 of the Constitution of India has been filed with a prayer to direct the Special Session Judge Gangster, Banda to accept and decide the objection dated 07.03.2024 of petitioners in S.T. No. 392/23 (State vs. Shiv Narest and others) arising out of Case Crime No. 195 of 2022, under Section 2/3 Gangster Act, Police Station Atarra, District Banda, within stipulated period as may be fixed by this Hon'ble Court.

It has been submitted by learned counsel for the petitioners that the objection/representation is pending consideration before the court concerned.

Considering the facts and circumstances of the case and in the interest of justice, this petition is disposed of with a direction to the court concerned to take appropriate decision strictly in accordance with law and decide the objection/representation of the petitioners dated 07.03.2024 as expeditiously as possible, preferably within a period of two months from the date of production of certified copy of this order.

It is made clear that this Court has not entered into the merits of the case and thus it is for the court concerned to take a decision independently in accordance with law.

With the aforesaid direction, the writ petition is finally disposed of.
