At the very outset, learned Standing Counsel has raised a preliminary objection regarding maintainability and the entertainability of the present petition in the light of the order passed by this Court dated 20.03.2024 in Case No. 1401 of 2024 (Matters under Article 226), which was preferred by the petitioner earlier, where this Court had given liberty to the petitioner to file afresh after getting array of parties corrected before the trial Court, which has yet not been corrected and the present petition has been filed by the petitioner.
At this stage, learned counsel for the petitioner has submitted that petitioner may be permitted to withdraw the present petition with a liberty to the petitioner to file a fresh petition at an appropriate stage.
As prayed, the present petition is dismissed as not pressed with liberty to file afresh petition at an appropriate stage.
