The present writ petition has been filed for issuing a direction to respondent no.2 to decide the application under Section 5 of the Limitation Act filed along with restoration application and application for interim relief/filed by the petitioner in Case No.353 of 2023 (computerized no. T202310640100353; Tarsem Singh vs. Sohan Singh) and with a further prayer to direct the respondents to maintain status quo and not to alienate the land of gata no.120 having an area 1.7690 hectare, situated at Naimsaranya, Tehsil Mishrikh, District Sitapur.

Learned counsel for the petitioner has submitted that the respondent nos.3 to 5 by playing fraud had got their name mutated in the revenue records not once but twice. It is further submitted that the petitioners have moved mutation application under Section 34 of U.P. Revenue Code in the year 2023 which was dismissed for want of prosecution on 27.03.2023, against which the recall application has been preferred on 04.03.2024 along with delay condonation application and on the said application a date has been fixed i.e. 12.04.2024.

Learned State counsel has accepted notices on behalf of respondent nos.1 and 2.

Issue notice to respondent nos.3 to 5, returnable at an early date.

Learned counsel for the petitioners prays for and is granted a week's time for taking steps.
