Heard learned counsel for the petitioners, learned Standing Counsel for the State and Sri Pankaj Gupta, learned counsel for the Gram Sabha.

The present writ petition has been preferred for issuing direction to the respondent no. 3 / Deputy Director of Consolidation/Chief Revenue Officer Distt. Gonda to decide the application preferred by the petitioners dated 30.10.2019 under Order I Rule 10(2) C.P.C. in reference/case/revision No. 52 (computerized no. CU2019530830000009) "Shankar Dayal Mishra vs. State and Ors." within a stipulated time as this Hon'ble Court may fix.

It is further submitted that so far prayer no. (ii) made in the present writ petition is concerned, liberty may be given to the petitioners to withdraw the same as dismissed as not pressed at this stage and approach this Court at the appropriate stage.

Learned Standing Counsel and Sri Pankaj Gupta, learned counsel for the Gram Sabha have no objection to the aforesaid prayer of learned counsel for the petitioners.

The prayer of the petitioners for withdrawal of the prayer no. (ii) as dismissed as not pressed is hereby allowed with liberty to the petitioners to approach this Court at the appropriate stage.

On the request of learned counsel for the petitioners and without entering into the merits of the case, the present writ petition is disposed of with a direction to the respondent no. 3 / Deputy Director of Consolidation/Chief Revenue Officer Distt. Gonda to decide the application preferred by the petitioners dated 30.10.2019 under Order I Rule 10(2) C.P.C. in reference/case/revision No. 52
