Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present application under Section 482 Cr.P.C. read with Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023 (in short "BNSS") has been filed for the following main relief:-

"Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to quashing of impugned order dated 04.06.2024 passed by learned Sessions Judge, Court No. 2, Sitapur in Criminal Revision No. 126/2023 and order dated 27.07.2023 passed by learned Chief Judicial Magistrate, Sitapur in Criminal Misc. Case No. 478/2023 U/s 156(3) Cr.P.C. (contained at Annexure No. 1 and 4 to this petition) in the interest of justice."

Vide impugned order dated 27.07.2023 passed in Case No.478 of 2023 (Bhanu Pratap Vs. Damodar & others), the Chief Judicial Magistrate rejected the application preferred by the petitioner under Section 156(3) Cr.P.C. The relevant portion of the order dated 27.07.2023 reads as under.

" थथानने सने पथा्቎ आख्यथा कने अननुसथार उपररो्ሹ पकरण कने सम्बन्ध मम थथानथा स्थथाननीय पर करोई अभभियरोग पपंजनीककत नहीሻ हहै। पथाथቕኍ दथारथा पनुललिस करो ककी गयनी आई०जनी०आर०एस० पर पनुललिस दथारथा ककी गयनी जथ ा च आख्यथा करो ससूचनी सने दथालखिलि भकयथा गयथा हहै , लजसमम जथ ा चकतथाቔኋ दथारथा इस तथ्य ककी पनुभቖኌ ककी गयनी हहै भक मकतक गरोभविन्द कथा सम्बन्ध भविपकनी भपयथा सने थथा तथथा भदनथापंक -29.05.2023 ककी रथाभቔኌ मम भपयथा सने हहई बथात कने उपरथान्त हनी मकतक दथारथा फफॉसनी लिगथाकर आत्महत्यथा ककी गयनी हहै। पथाथቕኍ दथारथा मकतक ककी परोस्टमथाटቔኋम ररपरोटቔኋ भिनी दथालखिलि ककी गयनी हहै , लजसमम ANTE MORTEM INJURIES-1 AN OBLIQUE LIGATURE MARK 28.6CM X 1.5CM PRESENT ON AROUND THE NECK ABOVE THYROID CARTILAGE INFRONT OF NECK PASSING OBLIQUELY UPWARDS AND BACKWARDS ALONG THE LINE OF MANDIBLE WITH A GAP OF 5.5 CM PRESENT ON LEFT SIDE OF NECK. SITUATED 4.5 CM BELOW CHIN AND 6.0 CM

BASE OF GROOVE OF LIGATURE MARK YELLOWISH, HARD AND PARCHMENT LIKE ON DISSECTION SUB CUTANEOUS TISSUE UNDER THE LIGATURE MARK WHITE, HARD AND GLISTENING. अभभिललिलखित हहै। मकतक कने शरनीर पर अन्य कहीሻ भिनी भकसनी भिनी पकथार ककी चरोट कथा भनशथान नहीሻ हहै। परोस्टमथाटቔኋम ररपरोटቔኋ मम मकत्यनु कथा कथारण Asphyxia Due to Antemortem अभभिललिलखित हहै। पथाथቕኍ कने अननुसथार भविपकनीगण दथारथा गरोभविन्द कने गलिने मम रस्सनी डथालिकर उसने पनेड़ सने लिटकथाकर उसककी हत्यथा कथाररत ककी गयनी हहै , भकन्तनु मकतक कने शरनीर पर अन्य करोई चरोट न हरोनथा तथथा परोस्टमथाटቔኋम ररपरोटቔኋ मम Antemortem HANGING INJURIES तथथा आन्तररक परनीकण सने भविपकनीगण दथारथा गरोभविन्द ककी मकत्यनु कथाररत भकयने जथानने कथा तथ्य भविश्विसननीय पतनीत नहीሻ हरोतथा हहै , बललक परोस्टमथाटቔኋम ररपरोटቔኋ कने आधथार पर मकतक गरोभविन्द दथारथा आत्महत्यथा भकयने जथानने कथा तथ्य हनी दभशቔኋत हरोतथा हहै। अततः उपररो्ሹ कथारणोሥ सने मनेरने मत मम पथाथቔኋनथा पቔኌ कने आधथार पर करोई सपंजनेय अपरथाधकथाररत भकयथा जथानथा पकट नहीሻ हरोतथा हहै , लजसकने पररणथामस्विरूप पथाथቔኋनथा पቔኌ अन्तगቔኋत धथारथा 156 (3) द०प०सपं० भनरस्त भकयने जथानने यरोग्य हहै।

पथाथቕኍ भिथाननु पतथाप ककी ओर सने पस्तनुत पथाथቔኋनथा पቔኌ अन्तगቔኋत धथारथा - 156 (3) द०प०सपं० भनरस्त भकयथा जथातथा हहै। पቔኌथाविलिनी भनयमथाननुसथार दथालखिलि दफ्तर हरो। "

Vide impugned order dated 04.06.2024, the Revisional Court dismissed the Revision No.126 of 2023 filed by the petitioner and affirmed the impugned order of Magistrate dated 27.07.2023.

To consider as to whether the Magistrate has rightly passed the order dated 27.07.2023, affirmed by the order of the Revisional Court dated 04.06.2024, impugned in the present petition, this Court took note of the contents of the response to the IGRS Complaint made by the petitioner, annexed at page no.42 of the present petition, as also the post mortem report, annexed at page no.38 of the present petition.

According to the aforesaid documents, it is apparent that cause of death shown by the Autopsy Surgeon is "Asphyxia Due to Ante Mortem Hanging" and for coming to the conclusion, the Autopsy Surgeon indicated ante mortem injuries as under.

"ANTE MORTEM INJURIES :- AN OBLIQUE LIGATURE MARK 28.06 CM X1.5 CM PRESENT ON AROUND THE NECK ABOVE THYROID CARTILAGE IN FRONT OF NECK PASSING OBLIQUELY UPWARDS AND BACKWARDS ALONG WITH LINE OF MANDIBLE WITH A GAP OF 5.5 CM PRESENT ON LEFT SIDE OF NECK. SITUATED 4.5 CM BELOW CHIN AND 6.0 CM BELOW RIGHT EAR. BASE OF GROOVE OF LIGATURE MARK YELLOWISH, HARD AND PARCHMENT LIKE. ON DISSECTION

SUB SUTANEOUS TISSUE UNDER THE LIGATURE MARK WHITE, HARD AND GLISTENING."

Upon due consideration of the aforesaid, this Court is of the view that the Magistrate after due consideration of ante mortem injuries indicated in the post mortem report and the cause of death shown therein passed the order dated 27.07.2023, which to the view of the Court is just and proper. Accordingly, no interference is required in the impugned order(s).

The present petition is, therefore, dismissed . No order as to costs.
