Heard learned counsel for the petitioners and learned Standing Counsel for respondents no. 1 to 5.

No notice need to be issued to the respondent nos. 6 to 9 taking into consideration the nature of order proposed to be passed.

With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally decided.

The instant writ petition has been filed praying for following main reliefs:

"[I] Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the respondent no. 1 to consider the proposal sent by respondent no. 2 on dated 07.01.2022 for grant of financial approval on the appointment of petitioners within reasonable time from as this Hon'ble Court may deem just and proper in the interest of justice.

[II] Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the respondents to pay the regular salary to the petitioners from the date of their joining by petitioner's no. 1 to 5 in service on 13.05.2017 and 04.07.2016 on the post of Assistant Teachers at respondent no. 7 and 9 with all consequential benefits.

[III] Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the respondent no. 1 to consider for releasing their salary in compliance of circular dated 07.07.2024 in favour of petitioners in similarly situated circumstances are interest of justice."

Contention of learned counsel for the petitioners is that the petitioners despite having been appointed on the post of Assistant Teachers in the year 2017, their salary has not been paid.

After arguing the matter at some length, learned counsel for the

petitioners submits that with regard to the reliefs sought in the writ petition, the petitioner may be permitted to submit a fresh representation before the respondent no.2 i.e. Director, Social Welfare, Uttar Pradesh, Lucknow which may be directed to be decided within a time frame fixed by this Court to which learned Standing Counsel for respondents no. 1 to 5 has no objection.

In view of the above, it is provided that in case the petitioners submit individual representations within two weeks from today before respondent no.2 then respondent no.2 shall endevour to decide the same by means of a reasoned and speaking order in accordance with law and the relevant rules within a further period of eight weeks from the date of submission of the individual representations along with certified copy of this order.

With the aforesaid direction, writ petition is disposed of .

It is made clear that this Court has not gone into the merits of the claim set forth by the petitioners.
