1. Heard learned counsel for the applicant and learned A.G.A. for the State.

2. The applicant seeks enlargement on bail in FIR No. 196 of 2024 under Section 498-A, 304, 323, 504, 506 I.P.C. and 3/4 of the Dowry Prohibition Act, Police Station- Hujoorpur, District -Bahraich.

3. In terms of the F.I.R. lodged on 5.5.2024 under Section 498-A, 323, 504, 506 I.P.C. and 3/4 of the D.P. Act and it was alleged that daughter of the informant was married to the applicant and substantial dowry was also given. It was also stated that the her daughter was beaten up for demand of dowry on various occasions and on 4.5.2024 she was beaten again. In the light of the aforesaid, learned counsel for the applicant draws my attention to the postmortem report which demonstrates the presence of the one contusion on the back of the head and four abrasions on the forehead, on the shoulder and on the knee He also draws my attention to the statement of the children, who stated that on the date of the incident mother of the said witness had gone to fetch water where she fell down and sustained injured which resulted into her death. He specifically stated that there was no fight between the applicant and the mother of the witnesses.

4. Learned A.G.A. opposes the bail application.

5. Considering the arguments raised at bar and statement of the aforesaid witnesses, the applicant, who is in jail since 27.6.2024 and has no criminal history, is enlarged on bail. Accordingly, the bail application is allowed.

6. Let the applicant Raju @ Shesh Narayan be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of

Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offences of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
