Every day this Court is being flooded with writ petitions seeking disposal of their claims under the Mukhya Mantri Sarvehit Kishan Beema Yojana and other similar schemes such as Mukhya Mantri Krishak Durghatna Kalyan Yojna etc. taking a lot of time of this Court in consideration of such pleas. In almost all schemes District Magistrates or the District Level Committee headed by him is the final authority to take a decision in the matter. In some cases, where the Insurance Companies have a role to play the initial decision is to be taken by the Insurance Company and thereafter if it is rejected, it is placed before the District Level Committee headed by the District Magistrate for its decision.

Be that as it may, considering the flood of litigation in this regard with which we are faced every day , it would be better if the Chief Secretary, Government of U.P. issues an order to all the District Magistrates through out the State of U.P. to kindly monitor and dispose of all such claims pending at his level or the committee headed by him in a time bound manner and also to ensure disposal of such claims, which may be pending before the Insurance Companies so that this Court is not flooded

with such petitions every day.

Some mechanism should be put in place by the District Magistrates so that the disposal of such claims is monitored and it is ensured that they are decided expeditiously and if there is any impediment in disposal of such claims, then the same is communicated to the concerned with proof of such communication being preserved at the appropriate level so as to ebb the tide of unnecessary litigation before the High Court.

Sri Anil Kumar Chaubey, learned Standing Counsel shall communicate our order to the Chief Secretary, Government of U.P. within one week for compliance as aforesaid within one month.

As regards the facts of this case are concerned, the counsel for the Insurance Company says that the claim of the petitioner has been responded on 16.08.2024 and thereafter it has been rejected on 26.08.2024. The communication has been sent to the District Magistrate also in this regard.

In view of the aforesaid, nothing survives for adjudication at this stage. If the matter is pending before the District Magistrate concerned,he shall take a decision in the matter expeditiously, say within three months.

The writ petition is disposed of in the aforesaid terms.
