After arguing at some length, learned counsel for petitioners has submitted that the petitioners do not want to press prayer no.1 which is quoted herein below:-

"i. issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 05.09.2022 passed by respondent no.3 to the extent denied the regularization of the petitioners, contained as annexure no.1 to this petition."

Learned counsel for petitioners has confined his prayer to the extent that a direction may be issued to respondent no.3 to decide the representation of the petitioners dated 19.09.2023 for considering their candidature for regularization under U.P. Regularization of Persons Working on Daily Wages or on Work Charge or on Contract in Government Departments on Group 'C' and Group 'D' Posts (Outside the Purview of the Uttar Pradesh Public Service Commission) Rules, 2016.

Learned State counsel has no objection to the said prayer made by learned counsel for petitioner.

Without entering into the merits of the case, the petition is disposed of with a direction to respondent no.3-District Horticulture Officer, Lakhimpur Kheri to consider and decide the representation of the petitioners dated 19.09.2023 pending before him in accordance with law within a period of three months from the date a certified copy of this order is produced.
