1. Heard learned counsel for the applicant, learned AGA and perused the record.

2. The applicant seeks enlargement on bail in FIR No.211 of 2024, under Section 74, 351(2), 351(3), 70(1) of BNS, P.S. Manjhila, District Hardoi.

3. The FIR in question was lodged alleging that on 01.07.2024, daughter of the informant had gone out of home when the two accused misbehaved with her and on her raising hue and cry, ran away. A similar statement was given under Section 180 BNSS, however, in the statement under Section 183 BNSS, the victim changed her stand and for the first time alleged that both of them had committed wrong on her also. In the medical examination held on 03.07.2024 which was done prior to the recording of the statement under Section 183 BNSS, no injury was observed.

4. Learned AGA has opposed the bail application.

Considering that there is no material to corroborate the allegation against the applicant and considering the fact that the victim herself has disclosed her age as 18 years, the applicant who is in custody since 07.07.2024 and has no criminal history, is entitled to be enlarged on bail. In view thereof, the application is allowed.

6. Let the applicant Mohan be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶11

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
