Heard learned counsel for the petitioner and learned State Counsel-opposite parties no.1 to 3.
As per the office report dated 7.12.2023, service on opposite party no.4 is deemed to be sufficient.
Power on behalf of opposite party no.5 has been filed by Mr. Mohd. Ateeq Khan, which is taken on record.
Petition has been filed challenging the order dated 20.5.2023 allegedly served on the petitioner on 8.7.2023, whereby the petitioner was dismissed from service.
At the very outset, learned counsel for the petitioner submits that the order under challenge is appellable and, therefore, seeks to withdraw the petition in order to avail the alternative remedy.
Considering the innocuous prayer made by the learned counsel for the petitioner, petition is dismissed as withdrawn granting liberty to file an appeal before the opposite party no.4Committee of Management, Abul Kalam Azad Inter College, Pratapgarh, who shall consider and decide the appeal expeditiously on merits within a period of six weeks from the date of submission of appeal along with a certified copy of this order.
