It is contended by learned counsel for the applicant that the applicant is innocent and he has been falsely implicated in the present case due to ulterior motive. He submits that the applicant is not named in the F.I.R. and the F.I.R. was lodged on 8.6.2022 against two persons alleging therein that the informant had purchased a plot from Sankalp Trading Services through its proprietor Om Prakash Verma. He next submits that name of the present applicant is surfaced during the investigation when the statement of the co-accused Atul Kumar Verma was recorded, who stated that he formed a company in the name and style Sangharsh Total Solution Private Ltd. wherein the applicant was working as an employee and the applicant was neither director nor promoter of the company. He next submits that the applicant was never involved in committing offence as it has wrongly been stated by the main accused Atul Kumar Verma. He submits that there are thirty three cases' criminal history, which has been explained in paragraph 17 of the affidavit filed in support of the bail application and except apart there is no criminal history of the applicant. Co-accused Chandan Yadav @ Sonu Yadav, has already been enlarged on bail by this Court, vide order dated 6.12.2022 passed in Criminal Misc. Bail Application No.14254 of 2022.
