Heard Sri Ramesh Chandra Gupta, learned counsel for petitioner as well as learned Standing Counsel for respondents.

It has been submitted by learned counsel for petitioner that the name of petitioner society Shree Nageshwar Baba Sanskrit Vidyalaya Samiti Dhaurahara Town Lakhimpur Khiri District Khiri while another society of a similar name, namely, respondent No. 5 i.e. Shree Baba Nageshwar Mahadev Sewa Samiti Mohalla Barin Tola Kasba Dhaurahara Kala, District Khiri has also been registered by respondent No. 2.

It is the grievance of the petitioner that both the societies are having similar name and consequently the registration of respondent No. 5 was under Section 3(2) of the Societies Registration Act, 1963 (as amended by State of U.P.) and accordingly, the registration of respondent No. 5 deserves to be cancelled.

It has been submitted that a complaint in this regard was submitted to respondent No. 2 on which a show cause notice was also issued to respondent No. 5 on 05.06.2015 but the proceedings are pending before Dy. Registrar, Firms Societies and Chits, Lucknow without being finalized and after arguing the matter at some length, he has submitted that grievance of the petitioner is substantially redressed in case respondent No. 2 is directed to consider and decide the compliant of the petitioner in this regard expeditiously.

Considering the innocuous prayer and request of the petitioner and also considering the fact that proceedings with regard to cancellation of registration is pending since 2015, respondent No. 2 is directed to consider and decide the application of the petitioner and also conclude the proceedings initiated by means of show cause notice on 05.06.2015 annexed as Annexure No. 6 to the writ petition expeditiously, say, within a period of two months from the date a certified copy of this

order is produced before him in accordance with after giving opportunity of hearing to the parties concerned.

With the above observations / directions, the writ petition stands disposed of.
