At the very outset, learned counsel for the petitioner states that he does not intend to file the rejoinder affidavit to the counter affidavit filed on behalf of the respondents. The aforesaid statement is recorded.
There is consensus at bar that the matter in issue is squarely covered by the judgment of this Court passed in Writ-A No. 7068 of 2024 Inre; Raj Krishna Vs. Union of India and Ors-2024:AHC-LKO:64830 decided on 19.09.2024.
Accordingly taking into consideration the aforesaid consensus, the present petition is allowed and the order impugned dated 05.07.2024, a copy of which is annexure 1 to the writ petition is quashed.
It is provided that the petitioner would also be entitled for the benefit of the judgment of Raj Krishna (supra)
