Heard learned counsel for the applicant and learned Standing Counsel.

This application under Section 12 of the Contempt of Courts Act has been filed alleging wilful disobedience of the judgment and order dated 25.05.2023 passed on Matter under Article 227 No. 2755 of 2023.

Learned counsel for the applicant submits that the Original Suit No. 72 of 2013 (Kamlesh Vs. Mangre) is pending before the respondent-Presiding OfÏcer since 2013, but since the same was not being decided, Petition under Article 227 No. 2755 of 2023 (supra) was filed. The Writ Court disposed of the matter vide order dated 25.05.2023 with the direction to the court concerned to make all endeavour to commence evidence within a period of six weeks from the date of production of the certified copy of the order, with the further direction to conclude the proceedings of Suit No. 72 of 2013, without granting any undue adjournment to either of the parties. Submission of the learned counsel for the applicant is that even then the proceedings have not been concluded till date.

On the other hand, Shri Gaurav Mehrotra, learned counsel appearing for the respondent, while placing written instructions dated 26.02.2024 duly signed by Mr. Arvind Kumar Singh III, Civil Judge (J.D.), Lalganj Ajhara, Pratapgarh, submits that the proceedings are going on and all endeavour are being made to conclude the same.

The said instructions are taken on record.

Considering the submissions made by the learned counsel for the applicant, learned counsel for the respondent and going through the contents of the contempt application, order of the writ Court dated 25.05.2023 as well as the contents of the written instructions, the contempt application stands disposed of with the expectation that the OfÏcer concerned shall conclude the proceedings in terms of the order of the writ Court dated 25.05.2023.
