Heard Shri Ajay Pratap Singh, learned counsel for the petitioner as well as learned Standing Counsel on behalf of respondents nos.1 & 2, Sri Ravi Singh, learned counsel appearing for respondent no. 3 and Shri D.K. Singh Chauhan, learned counsel on behalf of respondent no.4.

The grievance of the petitioner's institution is with regard to grant of affiliation by the State of U.P. for running D. Pharma course for the academic session 2023-24.

It has been submitted that the entire procedure for counseling and admission for the academic session 2023-24 is over, therefore, affiliation cannot be granted for the current session.

Counsel for the petitioner submits that the respondents should be directed to duly consider the application of the petitioner for affiliation for the next academic session i.e. 202425.

Counsel for the respondent, on the other hand, has submitted that according to the procedure the portal shall remain open for a period which shall be published by an advertisement issued by the respondent and in case, the petitioner applies and is found to be eligible, his application is liable to be considered for affiliation for the academic session 2024-25.

In light of the above, without entering into the merits of the case and deciding the controversy as raised by the petitioner, liberty is granted to the petitioner to move an appropriate application with regard to the affiliation for running of D. Pharma course for the academic session 2024-25. In case, the petitioner applies with regard to the affiliation for running of D.Pharma, his application shall be duly considered by the

competent authority in accordance with law.

With the aforesaid direction, the writ petition stands disposed of.
