Heard Sri Ajay Pratap Singh, learned counsel for petitioner as well as learned Standing Counsel for respondent No. 1 and Sri Gyanednra Kumar Srivastava, learned counsel for respondent No. 2.

It has been submitted by learned counsel for petitioner that petitioner society has establised a college, namely, A.K. Sharma College of Paramedical & Nursing, Village & Post Office Aduki,District Mathura for teaching the diploma in General Nursing and Midwifery and Diploma in OT Technician Course.

It has further been submitted stated that the diploma in General Midwifery and Diploma in OT Technician Course is being run and managed by Uttar Pradesh State Medical Faculty, Lucknow in accordance with rules and regulations framed by the State Government as well as from the Government of India from time to time which are applicable in the institutions.

The petitioner's society is interested to run Diploma in General Nursing and Midwifery Course and has applied for the said course on 18.05.2021 and claims that it has completed all the formalities necessary to run the said course and also deposited all the requisite fees.

It has further been stated that an inspection was held on 17.02.2022 where certain deficiencies were found in the petitioner's institution and they were asked to remove said deficiencies within a period of 15 days. It has further been stated that petitioner institution has removed all the deficiencies and informed respondent No. 2, accordingly a second inspection was conducted in the year 2023 where again certain deficiencies were noticed and finally the third inspection has to be carried out w.e.f 22.07.2024 to 31.08.2024 which date has already passed.

After arguing the matter at some length, the only grievance raised by learned counsel for petitioner is that he has already made a representation to the U.P. State Medical Faculty, Lucknow to defer the said inspection till 20.08.2024 as the repair of the building of the petitioner institution is underway and it will not be possible to carryout the inspection during this period and a innocuous prayer has been made on behalf of the petitioner for a direction to respondent No. 2 to consider and decide the representation dated 10.07.2024 (Annexure No. 11 ) of the petitioner expeditiously.

Learned Standing Counsel has opposed the writ petition and has submitted that the inspection was to commence from 22.07.2024 and in all probabilities the inspection team would have already reached the institution for inspection but could not confirm that the inspection is underway.

Learned counsel for petitioner has submitted that till today, the inspecting team has not reached the petitioner's institution for inspection.

In light of the above, the writ petiton is disposed of with a direction to respondent No. 2 to consider and decide the representation of the petitioner dated 10.07.2024 (Annexure No. 11) expeditiously, say, within a period of one week from the date a certified copy of this order is produced before him.

It is made clear that the direction of this Court is only subject to the fact that the inspection has not already been carried out till today at the petitioner's institution.

Office of this Court is directed to issue certified copy of this order today itself to learned counsel for petitioner as per rules.
