Heard Sri Suresh Chandra Tiwari, learned counsel for the applicant, learned Additional Government Advocate appearing for respondent no.1, and Sri Neeraj Pandey, learned counsel for respondent no.2.

Instant application under Section 482 Cr.P.C. has been filed praying for quashing of the summoning order dated 22.11.2022 passed by the Additional Civil Judge (J.D.)-IX/J.M. Raebareli in Complaint Case No.782 of 2019 under Sections 498-A, 323, 504, 506 IPC & 3/4 D.P. Act, Police Station Milarea, District Raebareli.

Learned counsel for the contesting parties contend that this Court vide order dated 18.04.2023 had referred the matter to Mediation Center of this Court for settling the dispute.

Subsequent thereto, the Mediation Center of this Court has submitted its report dated 22.05.2023, which is on record.

As per the report of the Mediation Center, both the parties have stated that the Complaint Case No.782 of 2019 under Sections 498-A, 323, 504, 506 IPC & 3/4 D.P. Act, Police Station Milarea, District Raebareli would be withdrawn/not pressed against each other. The report specifically states so in paragraph 6F(i).

Considering the aforesaid and there being consensus between the parties as well as considering the report of the Mediation Center of this Court dated 22.05.2023, the proceedings of Complaint Case No.782 of 2019 in re: Dr. Smt. Poonam Lata vs. Dr. Jitendra Kumar and others, under Sections 498-A, 323, 504, 506 IPC & 3/4 D.P. Act, Police Station Milarea, District Raebareli, pending before IX Additional Civil Judge/J.M. Raebareli are quashed.
