Heard learned counsel for petitioner, learned State Counsel for opposite parties no.1 & 2, Mr. Ranvijay Singh learned counsel for opposite party No.3 and Mr. Sunil Kumar, Advocate holding brief on behalf of Dr. Uday Veer Singh, learned counsel for opposite party No.4.

Petition has been filed seeking a direction to concerned authority for commencement of payment of salary on the post of Headmaster of Junior/ Composite School alongwith arrears and interest since he is officiating on the aforesaid post.

It is submitted that petitioner's case is covered by judgment rendered in the case of Tripurari Dubey & Anr. versus State of U.P. & Ors. passed in Writ A No.18228 of 2022.

Considering innocuous prayer being made by learned counsel for petitioner, without entering into the merits of the case and particularly since adjudication of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file a fresh representation before opposite party no.4 i.e. District Basic Education Officer, Barabanki is directed to take a final decision in the light of aforesaid judgment in case the same is applicable within a period of six weeks from the date a certified copy of this order is produced before the said authority.

With the aforesaid observation, petition stands disposed of .
