Heard Ashok Kumar Shukla, learned counsel for the petitioners and Ms. Swati Upadhyay, learned State Counsel.

In view of the proposed order, the notice to opposite party No. 2 is hereby dispensed with.

The petitioners namely, Hiralal @ Ludee, Guchhan @ Muhhan, Baldi @ Baidiram, Fandi, Nanhi @ Naniha and Chhotu have filed this 482 Cr.P.C. petition praying for quashing of the charge sheet datd 2.10.2023 and order of cognizance and summoning order dated 12.10.2023 and every proceeding arising out of the same pending in the court of C.J.M, Bahraich in Case No. 32229 of 2023, Case Crime No. 184 of 2023 u/s 147, 148, 323, 504, 506, 308 IPC, P.S. Rupaideeha, District Bahraich.

At the outset, learned counsel for the petitioners has prayed that the petitioner is ready to surrender before the learned court below and wants to move an application for bail, therefore, direction may be issued to the learned court below for expeditious disposal of bail application of the petitioner.

Learned Additional Government Advocate for the State has no objection to the aforesaid prayer.

Therefore, without entering into merits of the issue, the instant petition is disposed of , however, it is provided that in case the petitioners surrender before the learned court below within a period of four weeks from today and moves application for bail relating to the aforesaid criminal case, the same shall be considered and disposed of in the light of dictum of Apex Court in re: Satender Kumar Antil vs. CBI and others in Special Leave to Appeal (Criminal) No. 5191 of 2021 with expedition without adjourning the case for any unnecessary reason.
