Heard Sri Saad Husain, learned counsel for the petitioners as well as learned Standing Counsel for the State respondents and Sri Mahendra Kumar Srivastava, has put in appearance on behalf of respondent nos. 2 and 3, who submits that he will upload his vakalatnama during course of the day.

It is submitted by learned counsel for the petitioners that the petitioners were found using unfair means in IInd Semester LLB Examination and consequently without passing any order the respondents are compelling them to re-appear and re-write all the subject examinations for the aforesaid semester.

Learned counsel appearing for respondent nos. 2 and 3 on the basis of instructions has informed this Court that the Unfair Means Committee has passed appropriate orders wherein all the persons who were found to be using unfair means were directed to re-appear in all the papers and subsequently the said order has also been uploaded on the website of the University. A copy of the said order is annexed as Annexure 2 to the writ petition.

Learned counsel for the respondents submits that in case an application is made by the petitioners all the documents and decisions taken by the University directing the petitioners to re-appear in all the examinations shall be furnished to them within 24 hours of receipt of such application.

At this stage learned counsel for the petitioners submits that he may be permitted withdraw the present writ petition with liberty to file fresh writ petition assailing the order(s) passed by the respondent-University.

In the light of the aforesaid, present writ petition is dismissed as withdrawn with liberty to file fresh writ petition.
