Heard learned counsel for the applicant and Shri Ranvijay Singh, learned AGA and perused the record.

The applicant seeks enlargement on bail in FIR No.1015 of 2020, under Sections 420, 409 IPC, Police Station Gomti Nagar, District Lucknow.

Learned counsel for the applicant argues that against the applicant, as many as 129 cases of similar nature were lodged out of which the applicant has been enlarged on bail in as many as 113 cases which has been duly explained in paragraph 21 of the bail application.Hence, the applicant who is in jail since 21.5.2019 may be enlarged on bail.

Learned AGA has opposed the bail application.

Considering the fact that the applicant is in custody since 21.5.2019 and has been enlarged on bail in cases where the allegations are similar to the present case, the applicant is entitled to be enlarged on bail.

In view thereof, the bail application is allowed.

Let the applicant Ashish Kumar Srivastava @ Ashish Srivastava be released on bail in aforesaid FIR number on his furnishing a personal bond to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.

However, the applicant need not furnish any further surety over and above what was directed in the bail order dated 29.5.2024 passed in Crl. Misc. Bail Application No.1856 of 2024 arising out of Case Crime No.460 of 2021, under Sections 420, 406 I.P.C., Police Station Gomti Nagar, District Lucknow.
