Heard Sri Pradeep Kumar Tripathi, learned counsel for the petitioners, Sri Varun Pandey, learned counsel for the opposite party Nos.2 and 5 Sri Ashutosh Singh, learned Advocate holding brief of Sri Anurag Kumar Singh, learned counsel for the C.B.I. and Sri Kuldeep Srivastava, learned counsel for the opposite party No.4.
2. At the very outset, attention has been drawn towards one order dated 25.10.2024 passed by the Division Bench of this Court in Criminal Misc. Writ Petition No.8282 of 2024; Bipin Kumar Singh and others vs. State of U.P. & others, whereby in an identical circumstances the order has been passed by the Division Bench giving liberty to the petitioners of that writ petition, who were Investors in Shine City of Infra Project Private Limited to raise their claim/ grievance before the court concerned and the direction has been issued to the court concerned to take appropriate decision, strictly in accordance with law, if the claim is filed by that petitioners.
3. In the present case, the petitioners are also said to be the Investors in such project, therefore, instead of approaching this Court under Article 227 of the Constitution of India, the petitioners should file their writ petition before the Division Bench.
4. Learned counsel for the petitioners has also stated that the petitioners may be given liberty to file the writ petition before the Division Bench.
5. Considering the aforesaid facts and circumstances, this writ petition is dismissed being not pressed granting liberty to the petitioners to approach the appropriate Court.
