Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

The contention of the learned counsel for the applicant is that although the applicant was enlarged on bail in the year 2013, subsequently however, as the counsel for the applicant had misinformed him, he could not appear before the Court below on the date fixed and thus on the basis of non bailable warrant, he was arrested. It is argued that the applicant is a poor person and had gone out of state to earn a livelihood and assures that he shall cooperate with the trial.

In view of the said statement, the applicant is enlarged on bail. Accordingly, the bail application is allowed.

Let the applicant Sonu be released on bail in FIR/ Case Crime No. 85 of 2013, under Sections 498A, 304B IPC and Section 3/4 D.P. Act, Police Station Ashiyana, District Lucknow on his furnishing personal bonds and two fresh sureties of Rs.30,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶11

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶12

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.
