Heard learned counsel for petitioner, learned State Counsel for opposite parties 1 to 3 and Mr. Ravindra Singh Advocate holding brief on behalf of Mr. Mohan Singh learned counsel for opposite party No.4. In view of order being passed notice to opposite party No.5 stand dispensed with.

Petition has been filed seeking a direction to authorities for removal of alleged illegal encroachment by opposite party No.5 over gata No. 569, area 0.250 hectare, located in village Mohammadpur, Post Shri Ram Van Kutir, Tehsil Nawabganj, District Barabanki.

Learned State Counsel on the basis of written instructions dated 25th May, 2024, which is taken on record, submits that upon instructions no illegal encroachment was found on the gata in question.

In view of aforesaid fact, nothing more remains to be adjudicated in this petition. However liberty is granted to petitioner to file an application under Section 67 of the Revenue Code 2006 in case he is still aggrieved. If any such application is filed, same shall be considered and decided within the statutory time period after affording opportunity of hearing to all concerned including the alleged encroacher.

With the aforesaid directions, the petition stands disposed of.
