The application has been filed seeking to delete opposite parties no.4 and 5 in the array of parties, the application is allowed.

Heard learned counsel for the petitioner.

Present petition has been filed with the following prayers:-

"i) Issue order or direction, directing the opposite parties no.1 to expedite the proceedings of original suit no.04 of 2022 In Re: Jagdish Prasad Vs. Sheetla Prasad and others" Suit for permanent injunction with partition pending before him since 03.01.2022, within a stipulated time period as fixed by this Hon'ble Court.

ii) Issue an order or direction, directing the opposite party no.1 to decide the 4C2 application of the petitioner pending since 03.01.2022 within the stipulated time period as fixed by this Hon'ble Court."

Considering the fact that the application 4C2 is pending since 03.01.2022, the present petition is disposed off with direction to opposite party no.1 to conclude the hearing of the said application within a period of six weeks.
