Learned counsel for the petitioners has submitted that the petitioners are eligible and qualified to be promoted on the post of Joint Director/Chief Veterinary Officer from the post of Deputy Chief Veterinary Officer under handicapped quota in the Animal Husbandry Department since the selection year 2021-22 but their names were not considered under the reservation for handicapped quota in the said selection, which is provided in the Government Orders dated 28.07.2015, 18.04.2022 and 04.08.2022.

It is further submitted that the petitioners being physically handicapped fully eligible and entitled to be considered for promotion but when their names were not considered, the petitioners have made a representation dated 18.01.2024 to the respondent no.-1-Additional Chief Secretary, Animal Husbandry Department, Government of U.P. but till date no decision has been taken by the respondent no. 1.

After arguing at some length, learned Counsel for the petitioners have submitted that a liberty may be given to the petitioners to make an additional representation to the respondent no. 1 and he may be directed to take a decision on the representation dated 18.01.2024 alongwith the additional representation made by the petitioners within a stipulated time as this Court may fix.

Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioners.

On the request of learned counsel for the petitioners and without entering into the merit of the case, the present petition is disposed of with a liberty to the petitioners to move an additional representation to the respondent no. 1 within a period of one week from today. If any such a representation is made, respondent no. 1 shall consider and decide the representation

dated 18.01.2024 alongwith the additional representation made by petitioner, in accordance with law, within a period of six weeks from the date of production of certified copy of this order.
