This Contempt Application has been filed alleging non compliance of the order dated 22.08.2024 passed in Writ-A No.6736 of 2024; Dr.Nand Lal Shukla Versus Union of India and 5 others on the ground that the representation filed by the applicant has not been disposed of by the Commissioner, Rural Development Department, U.P., Lucknow on the ground that the matter is pending before the State Government for extension of period. The representation of the applicant has been disposed of by means of the office order dated 09th of October 2024 by the Commissioner, Rural Development Department, U.P., Lucknow, contained in annexure no.7 to this application.
Learned counsel for the applicant failed to indicate the power of the Commissioner for taking the decision on the extension of period of Ombudsman, MGNREGA.
He prays for dismissing the application as not pressed with liberty to avail the appropriate remedy as may be available under law.
The contempt application is, accordingly, dismissed as not pressed with the liberty as aforesaid.
