1. Heard Sri Devesh Shukla, learned counsel for the petitioner and learned Standing Counsel for the State-respondents and perused the record.

After arguing at some length, the learned counsel for the petitioner states that he does not intend to press the prayer/relief of the instant petition so far as the challenge to the order dated 04.04.2024, a copy of which is Annexure-1 to the petition, by which the claim of the petitioner for opening of the sealed cover for the post of the Joint Director has been rejected on account of pendency of a criminal case yet prays that as in terms of the Government Order dated 28.05.1997, a copy of which is Annexure-5 to the petition, Clause 10 of the said Government Order pertains to consideration for adhoc promotion where the period of more than a year has lapsed since adoption of the sealed cover as such he prays that the respondents may consider the claim of the petitioner for adhoc promotion to the post of Joint Director.

3. Learned Standing Counsel also does not have any objection to the same as Clause 10 of the aforesaid order specifically provides for such consideration within a period of one year from the date of adoption of the sealed cover.

4. Considering the aforesaid the writ petition is disposed of with a direction to the competent authority to consider the claim of the petitioner for ad hoc promotion to the post of Joint Director considering Clause 10 of the Government Order dated 28.05.1987 in

accordance with law. Let such consideration be done within a period of 6 weeks from the date a certified copy of this order is produced before it in accordance with law and relevant Government Orders.
