Heard learned counsel for petitioner and learned State counsel for opposite party no.1.

In view of order being passed, notices to opposite parties no.2 & 3 stand dispensed with.

Petition under Article 227 of the Constitution of India has been filed seeking a direction to court concerned for expeditious disposal of Regular Suit No.129 of 2021.

It has been submitted that the aforesaid suit had been filed for declaration in which all the defendants have put in appearance and have also filed their written statements but issues have not yet been framed despite directions in February 2023.

It appears that from a perusal of order-sheet that the original paper-book pertaining to suit proceedings is not yet available with the court concerned. The suit itself is in an inceptional stage and therefore no specific directions can be issued for a particular time frame at this stage.

However opposite party no.2 i.e. Court of Civil Judge (Senior Division), District Shrawasti is directed to expedite framing of issues in Regular Suit No.129 of 2021 (Pankaj versus Santosh Kumar & Ors.). Liberty is granted to petitioner to approach this Court again in case of inordinate delay in framing of issues or in decision in the suit proceedings.

With the aforesaid direction, the petition stands disposed of .
