Hon'ble Abdul Moin,J.
Shri Parmanad Sharma, learned counsel for the petitioner, after arguing at some length, states that he does not intend to press on with the writ petition inasmuch as, he intends to file a claim petition before the U.P. Public Services Tribunal and prays that the instant petition may be dismissed as withdrawn with the aforesaid liberty.
Considering that the petitioner is a senior citizen aged about 75 years, as such, it is provided that in case the claim petition is filed before the learned Tribunal within four weeks from today along with certified copy of this order then the learned Tribunal shall endeavour to decide the same on merits expeditiously.
Accordingly, the writ petition is dismissed as withdrawn with the aforesaid observation.
