Heard learned counsel for the petitioner. Notice on behalf of respondent nos. 1 to 3 has been accepted by the office of the learned Chief Standing Counsel. Sri Dilip Kumar Pandey, learned counsel has accepted notice on behalf of respondent no. 5.
In view of the order proposed by this Court, notice to the private respondent nos. 4 is dispensed with.
By means of the instant petition, the petitioner has approached this Court seeking expeditious disposal of the recall application in Suit No. T20161069061341 (Ghaseete and Others Vs. Mahaveer and Others) under Section 116 of the U.P. Revenue Code, 2006 which is accompanied by an application under Section 5 of the Limitation Act, 1963.
Having considered the aforesaid as well as noticing the extracts of the order sheet which have been brought on record as Annexure No. 4, there does not appear to be any accentuating circumstances where this Court may intervene to expedite the proceedings which is being initiated in June, 2024, however, the liberty shall be available to the petitioner to move an appropriate application before the court concerned and in case if such an application is moved, the court concerned shall pass appropriate orders thereon.
Accordingly, at this stage, the petition is dismissed , however, in case if any cause of expedition arises in future, this order may not come in the way of the petitioner.
